Case Profile: Helen

Background:
Helen was an 81 year old with a diagnosis of Alzheimer’s. She did not have any living relatives and Joyce, a friend from church, cared for her. Helen’s disease progressed to the point where she required skilled nursing care in a long-term facility. Helen was the victim of a sexual assault by another resident.

Action:
While Helen lacked the mental capacity to pursue her rights, Joyce enlisted our firm to be Helen’s voice. A lawsuit was filed by our firm on behalf of Helen against the nursing home operator alleging they failed to protect Helen from the other resident after receiving notice he had a propensity towards sexual aggression.

Result:
Joyce pursued this case to its successful resolution despite Helen’s death after the lawsuit was filed. The impact of this tragedy led to severe penalties being leveled by the State. In addition, the local media shed light on this nursing home allowing a prior sex offender in their facility to prey on our community’s elderly.
